Performance Security and Infrastructure Development:  Why is Liquidity King and What to Do About It?

Performance security plays an integral role in infrastructure project procurements. Learn about why performance security is needed and what regulatory and financing considerations factor into the equation. The panel will also discuss the varying types of performance security available – whether surety bonds, retainage, letters of credits or other products- and how those products are view in the eyes of project stakeholders including contractors, developers, rating agencies and performance security consultants.

Perspectives on Design, Innovation and Risk Allocation in Infrastructure Development

Innovative engineering and design proposals can result in material bid differentiation during the procurement of P3 projects. Whether the design reduces construction expense creating a cost advantage or provides greater utility to the public, creating a technical scoring advantage. Unfortunately engineering and design services are not performed without risk - most materially errors or omissions that result in construction delays, rectification costs and other expenses. Infrastructure developers, contractors building infrastructure as well as their advisors spend significant time trying to balance the risk-and-reward of leveraging design as a bid differentiator.  Join us to hear from our diverse panel as they discuss design practices and the role of risk in infrastructure development. The panel will also cover the role of Alternative Technical Concepts (ATCs) and other design risk issues from various perspectives across the spectrum of infrastructure project delivery methods. Lastly, the panel will cover design risk transfer mechanisms including their benefits and pitfalls as well as mitigating structures and strategies.
